What it costs

Wisconsin regulates credit-counseling and DMP services through the Wisconsin Adjustment Service Companies Act (Wis. Stat. ch. 218.02), administered by the Wisconsin Department of Financial Institutions (DFI). The Act requires DMP providers to be licensed by the DFI, caps fees, mandates surety bonds, and requires written disclosure of all fees before any agreement is signed.

APFSC fees are disclosed in writing before you enrol. There are no enrolment fees that exceed what Wisconsin Chapter 218 permits, no “monthly maintenance” charges that aren’t on the disclosure, and no fees taken from your first payment before any creditor receives a dollar.

How long it takes

Most DMP clients complete their plan in 3 to 5 years. Two illustrative client outcomes (names changed, dollars rounded):

Statute of limitations on credit-card debt in Wisconsin

The statute of limitations for credit-card debt and other written contracts in Wisconsin is six years under Wis. Stat. § 893.43. The clock runs from the date of the last payment or last written acknowledgment of the debt. (Wisconsin shortened this from a longer prior period in 2018.)

A debt past the statute is still owed — but a Wisconsin creditor’s right to sue is generally extinguished. Making a partial payment or written acknowledgment can restart the clock under Wisconsin law. If you are being sued on an old account, consult a Wisconsin consumer attorney before responding.

Wage garnishment in Wisconsin — earnings exemption protections

Wisconsin gives debtors stronger wage-garnishment protection than federal law. Under Wis. Stat. § 812.34, 80% of net earnings are exempt from garnishment for consumer debt — meaning a creditor can garnish at most 20% of disposable earnings, well below the federal cap of 25%. A garnishment also expires after 13 weeks unless the creditor renews it.

Wisconsin also exempts the first $1,000 in a bank account from levy and offers a head-of-household exemption that can further reduce the garnishable amount. Public benefits (Social Security, SSI, unemployment) are generally exempt.

Who regulates credit counselors and debt-relief agencies in Wisconsin

Adjustment service companies (the Wisconsin term for DMP providers) operating with Wisconsinites are regulated by the Wisconsin Department of Financial Institutions (DFI) under Chapter 218.02. Any agency that is not licensed by the DFI should be treated as a red flag.

Federal credit-counseling law in plain English

Under 11 U.S.C. § 109(h), any individual filing personal bankruptcy must complete a credit counseling session with a DOJ-approved agency within 180 days before filing, and a financial-management course before discharge. APFSC is approved to provide both certificates.
